HAGERSTOWN — Federal prosecutors on Tuesday filed a criminal information charging former state Delegate Robert Alan McKee, 59, with possession of child pornography, United States Attorney for the District of Maryland Rod J. Rosenstein said.

McKee has entered into a plea agreement in which he will plead guilty to the charge, his attorney, Timothy Maloney of Greenbelt, Md., said in a faxed news release Tuesday. …

The information filed in U.S. District Court in Baltimore, alleges that the images were transported across state lines or through foreign commerce.

McKee was not taken into custody, Marcy Murphy, public affairs specialist for Rosenstein’s office in Baltimore, said Tuesday afternoon. Murphy said she could not confirm that McKee had entered into a plea agreement.

“Mr. McKee is accepting responsibility for his actions,” Maloney said in the release from his office. “Since his resignation from the legislature, Mr. McKee’s main focus has been on getting well and staying well. He continues to progress with professional assistance and strong support from his family and friends and the Hagerstown community.” …

An initial court appearance will be scheduled, and McKee could be arraigned at the same time, Murphy said. He could enter a plea of guilty or not guilty at the arraignment, she said.

That a criminal information, and not an indictment, was filed means that McKee waived a presentation of charges to a federal grand jury, Murphy said.

No local charges had been filed against McKee as of Tuesday, Washington County State’s Attorney Charles Strong said. …
