Christian Rehab Sued for Sexual Harassment, Wrongful Termination

Calvary Addiction Recovery Center in Phoenix, Arizona, describes itself as a “treatment program … for men and women, 18 years and older, who are struggling with substance abuse and problem gambling. Our program is designed for those in search of a Christian or spiritual 12-step program; those who struggle with relapse or dual diagnosis; and for individuals looking for a nurturing, safe environment to begin a new life in recovery. We recognize that each client may be in different stages with regard to spirituality and we commit to meet each client at their point of need.”

“Calvary,” the website continues, “believes that a successful recovery program must include spiritual recovery and encourages each client to renew his or her relationship with God. The program incorporates two tracks: a Christ-centered track and a traditional 12-step track. Time for devotions, meditation and Bible study is offered each day, and Christian principles are integrated into the lectures and therapy sessions.”

Now, a former employee is suing Calvary Addiction Recovery Center, accusing CEO Chris Diamond of sexual harassment. In her complaint, courtesy of Courthouse News Service: Amy Johnson v. Calvary Center, Inc., Amy Johnson claims:

“Johnson began her employment with Calvary on or about November 8, 2008, as an office assistant.

“Shortly after being hired, Johnson was promoted to become theadministrative assistant to Calvary’s CEO, Chris Diamond (‘Diamond’).

“Commencing shortly thereafter and for the duration of her employment, Johnson endured unwanted sexual advances from Diamond that included late night and weekend phone calls requesting non-work related meetings, photographs of Diamond’s erect penis, and sexually explicit e-mails, text messages, and statements directed to Johnson.

“In the [sic] April of 2011, Johnson was scheduled to represent Calvary at a convention in Las Vegas. Johnson informed her supervisor that she did not want to attend the convention with Diamond. When Diamond found out about Johnson’s desire to avoid the convention, he called her into his office and reprimanded her. Based on these threats, Johnson elected to attend the Las Vegas convention.

“In order to avoid having to fly to Las Vegas, Johnson altered her flight schedule. Diamond also altered his flight, so that he could travel with Johnson.

“Upon arrival in Las Vegas, Diamond informed Johnson that she was expected to stay the night in his hotel room or she would be terminated.

“Johnson told Diamond in no uncertain terms that she would not have sexual relations with Diamond.

“Upon her return to Phoenix, Diamond’s demeanor toward Johnson changed and became hostile.

“Johnson complained to her supervisors about Diamond’s treatment of her, but no corrective action was taken.

“Instead, in May 2011, Johnson was placed on unpaid administrative leave and then terminated on July 29, 2011. …

“Johnson … was directly subjected to an unlawful discriminatory employment practice in violation of Title VII and ACRA in that her employment was terminated after complaining of unwanted sexual advances by Diamond.

“As a direct and proximate result of said sex discrimination, Johnson has lost substantial employment benefits including, but not limited to, wages, bonuses, benefits, and other financial losses in an amount to be proven at trial.

“As a further direct and proximate result of said discrimination, Johnson has suffered extreme and severe anguish, humiliation and emotional distress, which entitle her to compensatory damages in an amount that will be proven at trial. …

“The wrongful acts described above are so outrageous in character, so shocking in nature, and so extreme in degree, as to go beyond all bounds of decency, and to be regarded as atrocious and utterly intolerable in a civilized community. Said acts were intended to cause Johnson severe emotional distress, or carried out in reckless disregard of the near certainty that such distress would result from the wrongful acts. …”
